Nine years later, Quebec Parliamentarians are preparing to vote on a number of new measures to expand access to medical assistance in dying. The Living with Dignity citizen network and many observers are under no illusions about the outcome. However, one big question remains: How many MNAs will stand up in the <i>salon Bleu<\/i> to oppose any of the proposed expansions? <w:sdt sdttag=\"goog_rdk_2\">God forbid<\/w:sdt> a unanimous vote on a subject with such high ethical stakes<w:sdt sdttag=\"goog_rdk_4\">!<\/w:sdt> We are pleased that the government has announced that its MNA<w:sdt sdttag=\"goog_rdk_6\">s<\/w:sdt><br>will be <w:sdt sdttag=\"goog_rdk_7\">granted a free vote<\/w:sdt>, and we assume that all opposition parties will make the same choice. While the vote will probably take place very soon (no later than June 9, the end of the parliamentary session), here are four reasons to oppose the adoption of Bill 11, as amended by the Committee on Citizen Relations:<\/span><span style=\"font-size: 19.2px; color: rgb(68, 68, 68); font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">&nbsp;<\/span><\/p>\n<p style=\"text-align:justify\"><b><span lang=\"EN-CA\">1 &#8211; Severe physical impairment: insufficient<br>safeguards to prevent abuses<o:p><\/o:p><\/span><\/b><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">As Mr. Pier-Luc Turcotte, a member of the Expert Panel on the concept of neuromotor disability who does not support the conclusions of the final report, brilliantly put it (in an open letter published in French on June 1<sup>st<\/sup> by&nbsp;<a href=\"https:\/\/www.ledevoir.com\/opinion\/idees\/792126\/idees-se-depecher-a-faire-mourir-avant-de-faire-vivre\" target=\"_blank\"><i>Le Devoir<\/i><\/a>&nbsp;and <a href=\"https:\/\/www.noovo.info\/chronique\/se-depecher-a-faire-mourir-avant-de-faire-vivre.html\"><i><span style=\"color:#0563C1\">Noovo<\/span><\/i><\/a>):<br>&#8220;The extension of medical assistance in dying to people with physical disabilities opens the door to major abuses, with very few solid safeguards to prevent them.&#8221; <\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">We <w:sdt sdttag=\"goog_rdk_13\">were<\/w:sdt><w:sdt sdttag=\"goog_rdk_14\"> <\/w:sdt>pleased to co-sign this letter: \u201cSe d\u00e9p\u00eacher \u00e0 faire mourir avant de faire vivre\u201d with Mr. Turcotte, <w:sdt sdttag=\"goog_rdk_15\">an Occupational Therapist and <\/w:sdt>Assistant Professor at the University of Ottawa&#8217;s Faculty of Health Sciences, <w:sdt sdttag=\"goog_rdk_17\">along with<\/w:sdt> 17 other groups and individuals. The content of the op-ed alone should make people hesitate to support Bill 11. <w:sdt sdttag=\"goog_rdk_19\">It is also worth remembering <\/w:sdt>the Fifth Estate (CBC) documentary <w:sdt sdttag=\"goog_rdk_21\">which catalogued <\/w:sdt>many cases of abuse in English Canada: <a href=\"https:\/\/www.youtube.com\/watch?reload=9&amp;v=plinQAHZRvk&amp;feature=youtu.be\"><span style=\"color:#0563C1\">The Mess that is MAiD<\/span><\/a>. Bill 11 will not prevent such abuse<w:sdt sdttag=\"goog_rdk_23\">s<\/w:sdt>.<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">We must promote <b>medical assistance in living<\/b>!<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">&nbsp;<\/span><\/p>\n<p style=\"text-align:justify\"><b><span lang=\"EN-CA\">2 &#8211; Medical assistance in dying will be possible in cases of &#8220;happy dementia&#8221;, contrary to the consensus of the Special Commission and the Expert Panel<o:p><\/o:p><\/span><\/b><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">The comments of Dr. Fran\u00e7ois Evoy, who was invited to testify before the Parliamentary Commission on April 20<sup>th<\/sup> by Minister Sonia B\u00e9langer, <w:sdt sdttag=\"goog_rdk_24\">the minister<\/w:sdt> responsible for the legislation, makes us fear<w:sdt sdttag=\"goog_rdk_26\">ful of&nbsp;<\/w:sdt>this expansion (see <a href=\"https:\/\/twitter.com\/Vivredignite\/status\/1650864180315176962\"><span style=\"color:#0563C1\">1m30s video<\/span><\/a>, in French). The criterion of contempor<w:sdt sdttag=\"goog_rdk_27\">aneous<\/w:sdt> suffering remains in Bill 11, but we understand that the legislator now seems to accept the idea that &#8220;happy dementia&#8221; can hide <w:sdt sdttag=\"goog_rdk_29\"><i>psychological&nbsp;<\/i><\/w:sdt>suffering. Hence, a person who has signed an advance directive specifying that he or she wishes to receive MAiD even in the case of &#8220;happy dementia&#8221; could obtain it.<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\"><w:sdt sdttag=\"goog_rdk_31\">T<\/w:sdt>here is<w:sdt sdttag=\"goog_rdk_33\">, however,&nbsp;<\/w:sdt>strong opposition to this idea in many of the briefs presented at the consultations on Bill 11, <w:sdt sdttag=\"goog_rdk_34\">both <\/w:sdt>during the work of the Select Committee on the Evolution of the Act respecting end-of-life care (2021) and by the Expert Group on the Issue of Incapacity and Medical Aid in Dying (2019). Since Dr. Evoy&#8217;s remarks, the Committee on <w:sdt sdttag=\"goog_rdk_35\">C<\/w:sdt>itizen <w:sdt sdttag=\"goog_rdk_37\">R<\/w:sdt>elations has not added sufficient safeguards to discourage MAiD in cases of &#8220;happy dementia&#8221;. In addition, there is no acceptable framework for <w:sdt sdttag=\"goog_rdk_39\">the <\/w:sdt>clinical manifestations <w:sdt sdttag=\"goog_rdk_40\">for<\/w:sdt> receiv<w:sdt sdttag=\"goog_rdk_42\">ing<\/w:sdt> MAiD by advance directive. Many issues, including the sedation of individuals with diminished capacity prior to <w:sdt sdttag=\"goog_rdk_45\">administering <\/w:sdt>MAiD (which we discuss in <a href=\"https:\/\/vivredignite.org\/bill11-media-and-brief\"><span style=\"color:#0563C1\">our brief<\/span><\/a>), <w:sdt sdttag=\"goog_rdk_46\">have been<\/w:sdt> postponed until <w:sdt sdttag=\"goog_rdk_48\">the<\/w:sdt> practical guide <w:sdt sdttag=\"goog_rdk_50\">(to implementing the new legislation) <\/w:sdt>is drafted.<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">&nbsp;<\/span><\/p>\n<p style=\"text-align:justify\"><b><span lang=\"EN-CA\">3 &#8211; Profoundly unfair treatment of palliative care<br>hospices, particularly those not wishing to offer MAiD<o:p><\/o:p><\/span><\/b><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">From the outset, we denounced the idea of forcing palliative care hospices to offer medical assistance in dying. We were deeply disturbed when a new amendment proposed by Sonia B\u00e9langer, Minister for Health and Seniors, made the Bill <w:sdt sdttag=\"goog_rdk_51\">even <\/w:sdt>tougher on palliative care hospice<w:sdt sdttag=\"goog_rdk_52\">s<\/w:sdt>: &#8220;It (a hospice) cannot refuse to receive a person for the sole reason that the latter has submitted a request for medical assistance in dying&#8221;. This choice by the government is diametrically opposed to the wishes expressed by the <i>Alliance des maisons de soins palliatifs du Qu\u00e9bec<\/i> during public consultations, and conflicts with their admission criteria. By adding<w:sdt sdttag=\"goog_rdk_53\"> on Wednesday&nbsp;<\/w:sdt><w:sdt sdttag=\"goog_rdk_54\">evening <\/w:sdt>a ridiculously short deadline (of 6 months!) for palliative care hospices not wishing to offer medical assistance in dying (of which there are only 4), Bill 11 unfairly targets those living environments whose mission is to offer quality palliative care to their community, respecting the palliative culture that <w:sdt sdttag=\"goog_rdk_57\">has been<\/w:sdt> freely chosen.<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">&nbsp;<\/span><\/p>\n<p style=\"text-align:justify\"><b><span lang=\"EN-CA\">4 &#8211; Last-minute expansion &#8211; New MAiD locations: new<br>problems<o:p><\/o:p><\/span><\/b><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">News of the turnkey offer of MAiD by funeral homes made local headlines in <i>Le Canada fran\u00e7ais<\/i> (<a href=\"https:\/\/twitter.com\/denis_a_leonce\/status\/1654091057204789248\"><span style=\"color:#0563C1\">April 27<\/span><\/a><a href=\"https:\/\/twitter.com\/denis_a_leonce\/status\/1654091057204789248\"><sup><span style=\"color:#0563C1\">th<\/span><\/sup><\/a>), in an interview on the <i>ICI Premi\u00e8re&#8217;s<\/i> program (<a href=\"https:\/\/ici.radio-canada.ca\/ohdio\/premiere\/emissions\/le-15-18\/segments\/entrevue\/442392\/soins-fin-vie-aide-medicale-mourir-service-complexe-funeraire-accompagnement-personnalise\"><span style=\"color:#0563C1\">May 4<\/span><\/a><a href=\"https:\/\/ici.radio-canada.ca\/ohdio\/premiere\/emissions\/le-15-18\/segments\/entrevue\/442392\/soins-fin-vie-aide-medicale-mourir-service-complexe-funeraire-accompagnement-personnalise\"><sup><span style=\"color:#0563C1\">th<\/span><\/sup><\/a>), but it was<w:sdt sdttag=\"goog_rdk_60\"> <\/w:sdt>not until a publication in <i>La Presse<\/i> (<a href=\"https:\/\/www.lapresse.ca\/actualites\/sante\/2023-05-19\/soins-de-fin-de-vie\/aide-medicale-a-mourir-inc.php\"><span style=\"color:#0563C1\">May 19<\/span><\/a><a href=\"https:\/\/www.lapresse.ca\/actualites\/sante\/2023-05-19\/soins-de-fin-de-vie\/aide-medicale-a-mourir-inc.php\"><sup><span style=\"color:#0563C1\">th<\/span><\/sup><\/a>) that a tide of incredul<w:sdt sdttag=\"goog_rdk_62\">ity<\/w:sdt> followed. After expressing her discomfort, Minister B\u00e9langer decided to make an accommodation for<w:sdt sdttag=\"goog_rdk_64\"> <\/w:sdt>individuals wishing to receive MAiD in locations other than healthcare institutions, palliative care homes or their own homes. She proposed an amendment to prohibit the promotion and marketing of MAiD. Despite a sincere desire to avoid abuse, new problems <w:sdt sdttag=\"goog_rdk_65\">can only <\/w:sdt>be expected. <\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">Three examples:<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">-Funeral complexes may be tempted to inflate the price of other services in order to offer free room rental for MAiD;<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">&#8211;<w:sdt sdttag=\"goog_rdk_67\">Since<\/w:sdt> there <w:sdt sdttag=\"goog_rdk_69\">are conscience rights or right<\/w:sdt> of refusal included in the law, owners of inns, campgrounds, <w:sdt sdttag=\"goog_rdk_72\">or <\/w:sdt>cottages, public park authorities <w:sdt sdttag=\"goog_rdk_74\">or <\/w:sdt>any other managers who express their disagreement w<w:sdt sdttag=\"goog_rdk_75\">ith MAiD being offered in or on their property will&nbsp;<\/w:sdt>have to bear the odious consequences of a possible refusal;<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">&#8211; As <a href=\"https:\/\/twitter.com\/Vivredignite\/status\/1662086608454135810\"><span style=\"color:#0563C1\">MP Jo\u00ebl Arseneau pointed out<\/span><\/a> (in French) during the detailed study of the Bill, the availability of these new locations <w:sdt sdttag=\"goog_rdk_78\">for MAiD <\/w:sdt>risks making medical assistance in dying more attractive, <w:sdt sdttag=\"goog_rdk_79\">all the <\/w:sdt>while trivializing it even further.<\/span><\/p>\n<p style=\"text-align:justify\"><span lang=\"EN-CA\">If only this much effort and <w:sdt sdttag=\"goog_rdk_80\">so <\/w:sdt>many resources were deployed to<w:sdt sdttag=\"goog_rdk_82\">wards&nbsp;<\/w:sdt>increasing access to palliative care &#8211;
