{"id":1839,"date":"2015-03-13T13:39:36","date_gmt":"2015-03-13T17:39:36","guid":{"rendered":"http:\/\/vivredignite.org\/?p=1839"},"modified":"2015-03-13T13:39:36","modified_gmt":"2015-03-13T17:39:36","slug":"the-carter-decision-authorizes-only-assisted-suicide","status":"publish","type":"post","link":"https:\/\/vivredignite.org\/en\/the-carter-decision-authorizes-only-assisted-suicide\/","title":{"rendered":"The <em>Carter<\/em> decision authorizes only \u00a0assisted suicide"},"content":{"rendered":"<p>The  judgment of the Supreme Court of Canada (SCC) in <em>Carter<\/em> is not very clear as to whether it intended to \u00a0decriminalize only a physician\u2019s assistanceg to  a person to commit suicide or whether it also intended to decriminalize euthanasia  performed by a physician. In our opinion, the judgment decriminalizes only the  assistance provided by a physician to a person to commit suicide, but not  causing the death of a person. The decision is available on the Supreme Court  website (https:\/\/scc-csc.lexum.com\/scc-csc\/scc-csc\/en\/item\/14637\/index.do).<\/p>\n<p><!--more--><\/p>\n<p>Paragraph  147 of the judgment reads as follows:<\/p>\n<blockquote>\n<p>&quot;<a href=\"https:\/\/zoupio.lexum.com\/calegis\/rsc-1985-c-c-46-en#%21fragment\/sec241\" target=\"_blank\">Section 241&nbsp;<\/a>(<em>b<\/em>) and s.<a href=\"https:\/\/zoupio.lexum.com\/calegis\/rsc-1985-c-c-46-en#%21fragment\/sec14\" target=\"_blank\"> 14&nbsp;<\/a> of the <a href=\"https:\/\/zoupio.lexum.com\/calegis\/rsc-1985-c-c-46-en\" target=\"_blank\"><em>Criminal Code&nbsp;<\/em><\/a> unjustifiably infringe <a href=\"https:\/\/zoupio.lexum.com\/calegis\/schedule-b-to-the-canada-act-1982-uk-1982-c-11-en#%21fragment\/sec7\" target=\"_blank\">\u00a0s.7&nbsp;<\/a> of the <a href=\"https:\/\/zoupio.lexum.com\/calegis\/schedule-b-to-the-canada-act-1982-uk-1982-c-11-en\" target=\"_blank\"><em>Charter&nbsp;<\/em><\/a>and are of no force or effect to the extent that they prohibit  physician-assisted death for a competent adult person who (1) clearly consents  to the termination of life and (2) has a grievous and irremediable medical  condition (including an illness, disease or disability) that causes enduring  suffering that is intolerable to the individual in the circumstances of his or  her condition.&quot;<\/p>\n<\/blockquote>\n<p><strong>Note that,  in the French version of the judgment delivered on the morning of February 6,  the phrase &quot;l'aide d'un m\u00e9decin pour mourir&quot; actually read  &quot;l'aide m\u00e9dicale \u00e0 mourir&quot; and that this correction was made to  paragraphs 4, 127 and 147 of the decision that contain the true r<em>atio decidendi<\/em> \u00a0of the judgment!<\/strong><\/p>\n<p>In the  original English version of the judgment, the SCC uses the term  &quot;physician-assisted death&quot; in paragraphs 127 and 147. However, the  use of &quot;<strong>a physician's assistance in terminating life<\/strong>&quot; in paragraph  126, accompanied by a reference to s. 241(b) and s. 14 as those that prohibit  such assistance, and the reference in paragraph 120 to euthanasia and murderas  being possible consequences of the legalization of assistance in dying \u00a0confirm that the Court intended to \u00a0decriminalize only <strong>a physician\u2019s assistance to  a person to commit suicide \u00a0but \u00a0not causing the death of a person<\/strong> referred to  in s. 222, even if performed by a physician.<\/p>\n<p>The same  reasoning applies to the French versionof the judgment, especially since at paragraphs  127 and 147, the SCC does not use the term &quot;aide m\u00e9dicale \u00e0 mourir&quot;  but rather &quot;aide d'un m\u00e9decin pour mourir &quot; and paragraphs 5, 6, 10,  22, 43, 45, 49, 84, 131 as well as Title IX of the decision confirm our interpretation.<\/p>\n<p> In our  opinion, if the Court had also intended to legalize euthanasia, it would have  rendered a clearer decision \u00a0than it did.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The  judgment of the Supreme Court of Canada (SCC) in Carter is not very clear as to whether it intended to \u00a0decriminalize only a physician\u2019s assistanceg to  a &#8230;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[290],"tags":[],"class_list":["post-1839","post","type-post","status-publish","format-standard","hentry","category-blog"],"_links":{"self":[{"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/posts\/1839","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/comments?post=1839"}],"version-history":[{"count":1,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/posts\/1839\/revisions"}],"predecessor-version":[{"id":1840,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/posts\/1839\/revisions\/1840"}],"wp:attachment":[{"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/media?parent=1839"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/categories?post=1839"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/vivredignite.org\/en\/wp-json\/wp\/v2\/tags?post=1839"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
